By accessing or using the Platform or placing an order, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872 to make purchases on the Platform. By using the Platform, you confirm that you meet these criteria and that the information you provide is true, accurate, and complete.
2. Account & security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately at support@nksappreals.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms or applicable law.
3. Products, pricing & availability
- All prices on the Platform are listed in Indian Rupees (INR / ₹) and are inclusive of applicable GST unless stated otherwise.
- We make reasonable efforts to display product colours, sizes, and descriptions accurately, but slight variations may occur due to monitor settings or photography.
- Prices, offers, and stock are subject to change without notice. In case of a pricing error, we reserve the right to cancel or correct the order with a full refund.
- Stock is limited — an item in your cart is not reserved until payment is successfully completed.
4. Orders & acceptance
Placing an order is an offer to purchase, which we may accept or decline at our discretion. An order is confirmed only upon receipt of payment and dispatch confirmation by email or SMS. We may cancel orders for reasons including but not limited to: stock unavailability, pricing errors, suspected fraud, or invalid shipping address. Any amount already debited will be refunded to the original payment method.
5. Payments
Payments are processed securely through Razorpay, our PCI-DSS compliant payment partner regulated by the Reserve Bank of India. We accept credit cards, debit cards, UPI, net banking, popular wallets, and EMI options where enabled. By submitting payment details, you represent that you are authorized to use the chosen instrument. NKS Apparel is not liable for any loss arising from incorrect payment information or third-party payment gateway failures.
6. Shipping & delivery
Shipping timelines, charges, and serviceable pin codes are described in our Shipping Policy. Title and risk in the products pass to you upon delivery to the address you have provided.
7. Returns & refunds
Returns, exchanges, and refunds are governed by our Return & Refund Policy. Refunds are processed to the original payment method within the timelines specified there.
8. Use of the Platform
- Use the Platform only for lawful purposes and in accordance with these Terms.
- Do not attempt to gain unauthorized access, interfere with operations, or use bots, scrapers, or automated tools without our written permission.
- Do not upload or transmit content that is unlawful, infringing, defamatory, obscene, or otherwise objectionable.
- Do not impersonate any person or misrepresent your affiliation with any person or entity.
9. Intellectual property
All content on the Platform — including logos, trademarks, product designs, photographs, text, graphics, and software — is owned by or licensed to NKS Apparels LLP and is protected under Indian and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent. Limited personal, non-commercial use of the Platform is permitted.
10. User-generated content
By submitting reviews, photographs, or other content to the Platform, you grant NKS Apparel a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, display, and distribute such content in connection with the Platform and our marketing.
11. Disclaimers
The Platform is provided on an “as is” and “as available” basis. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
12. Limitation of liability
To the maximum extent permitted by law, NKS Apparels LLP, its partners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform or any product purchased through it. Our aggregate liability in respect of any claim shall not exceed the amount actually paid by you for the product giving rise to such claim.
13. Indemnification
You agree to indemnify and hold harmless NKS Apparels LLP and its partners, employees, and agents from any claim, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms or your violation of any law or third-party right.
14. Force majeure
We shall not be liable for delays or failure in performance caused by events outside our reasonable control, including acts of God, war, pandemic, government action, strikes, courier failures, natural disasters, or technical disruptions.
15. Governing law & jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts at Morbi, Gujarat.
16. Changes to these Terms
We may revise these Terms from time to time. The revised Terms become effective on posting. Your continued use of the Platform after such posting constitutes acceptance of the revised Terms.
